1. Acceptance of Terms
By applying for or using Kaya's luxury handbag membership service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service.
2. Membership Service
Kaya provides a luxury handbag membership service that allows approved members to:
- Access our curated collection of authentic designer handbags
- Enjoy one handbag at a time for up to one month
- Swap handbags as many times as desired within the membership period
- Receive cleaning and concierge services as part of the membership
3. Membership Application
Membership to Kaya is by application only. We reserve the right to approve or decline applications at our sole discretion. Membership is currently limited to residents of Cape Town, South Africa.
4. Membership Fees
Membership fees are R1,999 per month and are billed monthly in advance. Fees are subject to change with 30 days' notice. All fees are non-refundable except as required by law.
5. Care and Responsibility
As a member, you agree to:
- Handle all handbags with appropriate care
- Use handbags only for their intended purpose
- Report any damage immediately
- Return handbags in the same condition as received (excluding normal wear)
6. Damage and Loss
Normal wear and tear is covered by your membership. However, you will be liable for repair or replacement costs for significant damage, loss, theft, or negligence. Our care team will assess damages and provide fair pricing for repairs or replacements.
7. Availability
Handbag availability is subject to demand and our collection inventory. We cannot guarantee availability of specific items at specific times. We provide transparent availability information when you request your next piece.
8. Termination
Either party may terminate the membership with 30 days' written notice. Upon termination, you must return any handbags in your possession within 7 days. We reserve the right to terminate memberships immediately for breach of these terms.
9. Intellectual Property
All content on our website and marketing materials, including text, graphics, logos, and images, is the property of Kaya and is protected by copyright and other intellectual property laws.
10. Limitation of Liability
Kaya's liability is limited to the monthly membership fee. We are not liable for any indirect, incidental, special, or consequential damages arising from the use of our service.
11. Governing Law
These Terms and Conditions are governed by the laws of South Africa. Any disputes will be resolved in the courts of Cape Town, South Africa.
